The steps for the acquisition of real estate in Morocco
Acquiring real estate is not easy, fortunately we summarize all the steps through a brief summary
Acquiring real estate in Morocco involves several steps. Here is a general overview of the process:
Property search: Start by defining your search criteria (type of property, location, budget, etc.) and explore the real estate offers available in Morocco. You can check real estate websites, contact real estate agencies, or look for advertisements in local newspapers.
Property Tour: Once you've spotted interesting properties, arrange tours to see them in person. This will allow you to assess their condition, location and suitability for your needs.
Legal checks: Before committing to the purchase, make sure you have all the necessary legal checks carried out. This may include consulting a lawyer specializing in Moroccan real estate law to check the legal documents of the property, such as the title deed, building permits, possible encumbrances, etc.
Negotiation and offer: If you are interested in a particular property, you can start negotiations with the seller to agree on the price and the conditions of purchase. Once you have reached an agreement, you can make an offer to purchase in writing.
Signing of a sales agreement: Once your offer has been accepted, you can sign a sales agreement (or promise of sale) with the seller. This contract defines the conditions of sale, including the price, deadlines, terms of payment, etc. You will usually need to pay a deposit at this stage, which is usually around 10% of the purchase price.
Final checks and deed of sale: Before finalizing the transaction, you must carry out final checks on the property, in particular by ensuring that there are no outstanding disputes. Once these checks are completed, you can proceed to the signing of the deed of sale with a Moroccan notary. At this point, you will have to pay the balance of the purchase price, notary fees and applicable taxes.
Registration of the deed of sale: Once the deed of sale is signed, it must be registered with the Moroccan land authorities to formalize the transfer of ownership.
It is important to note that the precise steps may vary depending on the nature of the property (apartment, villa, land, etc.) and the regulations specific to each region. It is always recommended to consult a real estate professional or a specialized lawyer to accompany you throughout the acquisition process.
